Courts look to see how long you were off work and what activities you can no longer do. If you continue to work after your accident and your activities are not significantly altered, then you are probably not suffering from a serious impairment of a body function. If you have scarring from the accident, an experienced attorney can evaluate whether or not you have a serious and permanent disfigurement.

How long after an accident do I have to file a claim?

In Michigan, accident victims have one year to file a lawsuit with their own insurance company for No-Fault benefits. They have three years to file a lawsuit against the at fault driver for pain and suffering. It’s crucial that accident victims know these time limitations as the penalties for failing to file on time can result in losing the right to pursue the claim and recover the benefits and compensation they would otherwise be entitled to.
