No-Fault Insurance Benefits for Pedestrians

The Michigan Legislature recently enacted reforms to the No-Fault Act. Knowing how to navigate those changes can be the difference between receiving much needed benefits and facing difficult life challenges. Despite the changes, Michigan is still a No-Fault State, meaning, pedestrians involved in accidents are entitled to insurance coverage regardless of fault. So it doesn’t matter if the pedestrian broke any traffic laws. Under Michigan Compiled Law section 500.3115, pedestrians involved in a motor vehicle accident must first seek recovery for personal protection (PIP) payments from their own insurer. If the pedestrian does not carry auto insurance, they may seek PIP benefits from the insurer of a spouse or a resident relative domiciled in the same household, meaning, a family member living with the injured pedestrian. In circumstances where neither the injured pedestrian, nor a resident family member have auto insurance, benefits may be pursued through the Michigan Assigned Claims Plan. The benefits, however, are capped at $250,000.00.
