No-Fault Insurance Benefits for Motorcyclists

Under Michigan’s No-Fault laws, a party injured while on a motorcycle, either as the operator, or as an occupant, must be aware of their rights, as well as the necessary steps to protect their interests.

Michigan is a no-fault state, meaning, regardless of fault, a party injured in an accident while on a motorcycle may be entitled to benefits. The Michigan Legislature recently amended Michigan’s No-Fault Act. Understanding the changes is essential. An injured operator or occupant of a motorcycle may receive no-fault personal protection (PIP) benefits if they are injured in an accident involving a motor vehicle, such as a car, a truck, etc. The injured operator or occupant of the motorcycle may, in many cases, receive PIP benefits from the insurer of the owner of the motor vehicle. This process is limited, however, by whether the involved motor vehicle is insured, as well as the amount of the coverage.

If the motor vehicle involved in the accident is not insured, PIP benefits may be recovered from the insurer of the operator of the motorcycle. If such coverage is not available, the benefits may be sought from the owner of the motorcycle. Finally, in the event that other options are unavailable, benefits may be available from the Michigan Assigned Claims plans.
